Terms for CareFile early access.
Plain English terms for the current invite-only early access phase. These cover what the service is, how to use it, and what each side is responsible for.

These terms have not yet been reviewed by a lawyer. They apply to invited early access participants only. They will be reviewed and updated before CareFile opens to general registration.
About these terms
These terms govern your use of CareFile, a participant-controlled health and support record operated by Sami Zafier (ABN on record, trading as CareFile), located in Australia.
By creating an account or using CareFile you agree to these terms. If you do not agree, do not use the service.
These terms are a draft pending legal review. They will be updated before CareFile opens to general registration. The current version applies to invited early access participants only.
The service
CareFile is a participant-controlled digital record that lets you organise health information, disability support details, documents, and related records in one place.
CareFile is not a clinical service. It does not provide medical advice, diagnosis, treatment recommendations, or prescriptions. It does not replace clinical records held by your GP, hospital, specialist, or pharmacy.
CareFile is not affiliated with, endorsed by, or connected to Medicare, myGov, the NDIS, My Health Record, Services Australia, or any government agency.
During early access, CareFile is invite-only. Access is granted at our discretion and may be withdrawn.
Your account
You must be at least 18 years old, or have the legal authority to manage records on behalf of someone you support, to create an account.
You are responsible for keeping your login credentials secure. Do not share your password. Enable multi-factor authentication if offered.
Each account is for the management of one participant profile. You may invite trusted people to view a scoped portion of the record through CareFile's sharing features.
You must provide accurate information when creating an account. If your email address or other contact details change, update them promptly.
How you may use CareFile
You may use CareFile to organise personal health and support information for yourself or someone you are legally authorised to support.
You must not use CareFile to store or manage information about another person without appropriate legal authority – for example, a guardianship order, enduring power of attorney, or written consent.
You must not attempt to access another participant's records without their explicit consent, or use CareFile for any unlawful purpose.
You must not misuse the service, including attempting to circumvent security controls, overload the platform, or extract data in bulk without authorisation.
Your information
You own the information you enter into CareFile. We do not claim ownership of your health records, documents, or personal details.
You grant CareFile a limited licence to store and process your information for the sole purpose of operating the service and providing it to you.
You are responsible for the accuracy of the information you add. CareFile does not verify clinical records, diagnoses, medication details, or any other health information you enter.
You can export, correct, or request deletion of your information. See our privacy policy for how these requests are handled.
Health information disclaimer
CareFile is an organisational tool, not a clinical one. Nothing in CareFile – including medication details, condition summaries, allergy records, drug reference information, or any AI-assisted suggestions – constitutes medical advice.
Always consult a qualified health professional for decisions about diagnosis, treatment, medication, dosage, or care planning. Do not delay seeking professional medical advice because of information in CareFile.
Drug reference data in CareFile is sourced from publicly available databases and is provided for organisational reference only. It may not reflect current prescribing guidelines, individual circumstances, or the most recent product information.
Privacy
Our privacy policy explains how CareFile collects, stores, uses, and discloses your personal and health information, and how you can exercise your rights under the Privacy Act 1988 (Cth).
CareFile is designed with the Australian Privacy Principles as reference points. This does not mean the service has been formally certified or approved by any regulator.

CareFile uses a small number of third-party services to operate. These currently include Resend for transactional emails (sign-in links, password reset), Addresser for Australian address lookup, and AWS for hosting and storage.
We do not sell your information to third parties. Third-party services only receive the minimum information needed for their specific function.
CareFile's full vendor register will be published before general availability.
Availability and changes
CareFile is provided on an as-available basis. We do not guarantee uninterrupted access or that the service will be error-free.
We may change, suspend, or discontinue features at any time during early access. We will give reasonable notice of significant changes where possible.
We may update these terms. We will notify you of material changes by email or in-app notice before they take effect. Continued use after the effective date constitutes acceptance.
Limitation of liability
To the extent permitted by Australian law, CareFile's liability for any claim arising from use of the service is limited to the amount you paid for the service in the preceding 12 months (if any).
CareFile is not liable for loss or corruption of data, reliance on health information entered in the app, inability to access the service, actions of third parties, or indirect or consequential loss of any kind.
Nothing in these terms limits rights you may have under the Australian Consumer Law or other non-excludable statutory guarantees.
CareFile holds health information about real people. We take this responsibility seriously and commit to operating the service with appropriate care and security controls.
Termination
You may close your account at any time by contacting us. We will confirm deletion of your health records in accordance with our data retention policy.
We may suspend or terminate accounts that violate these terms, misuse the service, or where continued access poses a risk to the security or integrity of the platform.
On termination, your right to access CareFile ends. You should export your records before closing your account if you want to keep a copy.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute arising from these terms or your use of CareFile will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
